These Terms and Conditions ("Terms") govern your use of pool maintenance, repair, and related services ("Services") provided by Pool Ninja, in partnership with Nevergreen Pools (collectively, "Pool Ninja," "we," "us," or "our"). By scheduling, requesting, or accepting Services from us, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By submitting a service request, signing a service agreement, or otherwise engaging Pool Ninja, you confirm that you have read, understood, and agreed to these Terms. We reserve the right to update or modify these Terms at any time without prior notice. The most current version will always be posted on our website.

2. Description of Services

Pool Ninja provides residential pool and spa maintenance, equipment inspection, filter cleaning, water balancing, repair, installation, and related services. The specific scope of work for each Client is described in the agreed-upon service plan, work order, or written estimate.

3. Eligibility

You must be at least 18 years of age and the owner of the property where Services are performed, or otherwise authorized by the property owner to engage Pool Ninja for Services at the property.

4. Scheduling, Access, and Performance

  • Service days and frequency are established at the start of your agreement and are subject to change due to weather, holidays, or routing.
  • You agree to provide unobstructed access to the pool, equipment, and any necessary utility connections on scheduled service days.
  • Pets must be secured during service visits. Pool Ninja is not responsible for animals that escape due to a gate left open after access has been requested by the Client.
  • If our technician is unable to access your pool on a scheduled visit due to a locked gate, unsecured pet, or other obstruction, you may still be charged for that visit.

5. Pricing and Payment

  • Rates for Services are quoted in writing and may be adjusted with at least 30 days' written notice.
  • Recurring service fees are billed monthly in advance unless otherwise agreed. One-time services and repairs are invoiced upon completion.
  • Accepted payment methods include credit card, ACH/electronic transfer, and any other method we make available.
  • Past-due balances may incur a late fee and may result in suspension of service until the account is brought current.

6. Chemicals and Materials

Standard pool chemicals required for normal weekly water balancing are included in the recurring service fee unless otherwise specified. Specialty treatments, replacement parts, equipment, and labor for repairs are billed separately and will be communicated to the Client before work begins whenever reasonably practical.

7. Cancellation and Refunds

  • Either party may cancel recurring service with 14 days' written notice.
  • Prepaid service fees are refunded on a prorated basis for unused service days within the cancellation window.
  • One-time and emergency services are non-refundable once dispatched.

8. Property Access and Authorization

By engaging our Services, you grant Pool Ninja and its technicians limited authorization to enter your property at the agreed-upon times for the sole purpose of performing the Services. We will use reasonable care to safeguard your property while on site.

9. Equipment Repairs and Installations

Where Pool Ninja performs equipment repair or installation, manufacturer warranties on parts will be passed through to the Client. Labor on repairs is warrantied for 30 days from the date of completion unless otherwise stated in writing. Pool Ninja is not responsible for damage caused by pre-existing conditions, prior repairs performed by third parties, or normal wear and tear.

10. Limitation of Liability

To the fullest extent permitted by law, Pool Ninja's total liability for any claim arising out of or related to the Services shall not exceed the amount paid by Client for the specific service that gave rise to the claim. In no event shall Pool Ninja be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of use, lost revenue, or property damage not directly caused by Pool Ninja's negligence.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pool Ninja, Nevergreen Pools, and their respective officers, employees, and agents from and against any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your negligence.

12. Privacy

We collect Client contact information, service address, and payment information solely for the purpose of providing Services and operating our business. We do not sell your personal information. For more details, please contact us using the information below.

13. Photography and Service Documentation

As part of our standard service workflow, our technicians may photograph the pool, equipment, and water condition for the purpose of documenting work performed and communicating with the Client. These photographs are stored in our internal service records. We will not publicly share property photographs without your written permission.

14. Modifications to These Terms

We may update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in El Dorado County, California.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
